Dec 6, 2010 - SCC WRIT OF MANDAMUS


Under Sec 337 CCC: As to the OUTLINE and the AFFIDAVIT deliver my BC Court of Appeals file # CA033602 of March 14th, 2007 to a SCC preliminary court date in Vancouver on short leave,
in order to uphold our Sec 11 D guarantee to not be found guilty before the evidence is heard at a fair trial.

BASIC CHARGE: The City of Vancouver [CV] and the Province of British Columbia [BC] are in violation of Sec 19 of the Police Act for a total
FAILURE OF AN ENTITY TO COMPLY with the law,

and in so doing are subverting the Canadian Constitution,
and Democracy by ignoring the importance of their oath of Office

A] The function of this Mandamus is to expedite a remedy to 1-matter NAMELY:

I, Marc Boyer have been subjected to crimes of state
in the jurisdiction of the city of Vancouver [CV] by the Office of Attorney General of BC [AG] and Office of the Solicitor General of BC [SG] (but not limited to),

- who participated in the act of rigging my trial and the far greater liability created by the obstruction of Justice to provide a remedy to having rigged my trial, in case file # 157479-C2

AND IN SO DOING: CV, BC and Elections Canada are totally denying our Marijuana Party of Canada, the Constitutional right to protect our basic Democratic Sec 1 Charter guarantee that NAMELY:

[-i-] ‘ As prescribed by law’- The Supremacy of Parliament directly prohibits even an AG to use arbitrary power over the Loyal opposition of a federal Party who is upholding his Party’s RUBRIC and to say the least, one of the most repugnant abuse of power available to an AG is to rig the trial of anyone.

[-ii-] The matter before this preliminary court appearance is to determine from the evidence pressed whether to send this Sec 11 D violation as a civil case or as a criminal case file, on the understanding that it makes no sense to pursue both AND/OR the SCC can use this preliminary trial to throw out the matter.

[ B ] THE ISSUE is to fix my abnormal birth: by delivering to me a Commonwealth Passport

[-i-] The issue of landing my birth has been festering with CV and BC for over 7-years now, and this issue was addressed in my Oct 21st Notice, [and in numerous other attached docs]

- This last notice was served on Paul Hancock and the Mayor and this Notice caused Paul Hancock to resign from CV, because the City’s ongoing solution of just ignoring this notice conflicted with his oath of being the Holder of the Scepter and his duty as Director and registrar of births and deaths of CV.

[-ii-] The SCC must address its duty to the deep Constitutional issues that arise from fixing my ID issue when this court is clearly the last court that can revolve my ID issue and provide travel documents

[ C ] BY DEFINITION the SCC simply cannot ignore their duty to rule on my Mandamus as an Essential Element to preserve a ‘Free and Democratic society’ as defined in Sec 1 of the Charter.
